Other Party Liability

If another party is responsible for a member’s illness or injury, the benefits paid under this program will be subject to subrogation. Subrogation means that we will recover the amounts we have paid in benefits out of the proceeds of any settlement or judgment that the member receives as a recovery from the other party, the other party’s insurer, or any other insurance recovery, whether or not the member is made whole by the recovery, and whether or not the recovery includes any amount for covered services.
